Legal Protection Framework 42 U.S.C. ยง 3604(f)(3)(B)

The Fair Housing Act: Invoking Reasonable Accommodation to Halt Evictions

Since Hoarding Disorder was formally categorized as a distinct psychiatric disability in the Diagnostic and Statistical Manual of Mental Disorders (DSM-5 300.3), tenants in the United States are protected under the federal Fair Housing Amendments Act (FHAA). Landlords and public housing authorities cannot summarily evict an individual for lease violations resulting from a disability without considering a request for a Reasonable Accommodation.

1. Timely Request

Request must be submitted in writing as soon as a Notice to Cure, inspection failure, or lease termination letter is received.

2. Professional Support

Must be accompanied by a letter from a licensed physician, therapist, or social worker verifying the disability-related need for time.

3. Realistic Remediation Plan

Must outline a phased schedule (typically 30โ€“90 days) with milestone dates to clear egress paths, utilities, and fire hazards.

RE: REQUEST FOR REASONABLE ACCOMMODATION UNDER THE FAIR HOUSING ACT (42 U.S.C. ยง 3604)

Dear [Landlord / Property Manager Name],

I am writing on behalf of [Tenant Name], who resides at the address referenced above. [Tenant Name] is an individual with a recognized medical disability under the federal Fair Housing Act and state disability laws.

Due to the nature of this disability, certain household conditions have developed that currently do not meet property inspection criteria. Under 42 U.S.C. ยง 3604(f)(3)(B), it is unlawful to refuse to make reasonable accommodations in rules, policies, practices, or services when such accommodations may be necessary to afford an individual with a disability equal opportunity to use and enjoy a dwelling.

We respectfully request a Reasonable Accommodation consisting of an extension of [Insert Time, e.g., 45 to 60 days] from the date of this letter to cure the housekeeping and safety violations noted in your recent communication.

During this period, [Tenant Name] will be actively working with [Insert Professional Organizer / Remediation Company / Healthcare Provider] under a structured Harm Reduction Plan to achieve the following safety milestones:
1. Complete clearance of all primary and secondary emergency exits and hallways to a minimum width of 36 inches.
2. Removal of all combustible materials within 3 feet of heat sources, stove, and electrical breaker panels.
3. Remediation of any biological waste and restoration of all sanitary plumbing fixtures.

Attached please find verification from [Tenant's Healthcare Provider / Clinician] confirming the presence of a qualifying disability and supporting this request for additional remediation time.

We request your written response to this accommodation request within 10 business days. Thank you for your cooperation and understanding.

Sincerely,
[Your Name / Representative Signature]

What to Say: Non-Shaming Conversational Scripts

Traditional confrontations trigger acute panic and stubborn defensiveness. Use these therapeutic reframings inspired by Motivational Interviewing.

โŒ Shaming Language (Triggers Defense) โœ… Constructive Reframing (Preserves Dignity)
"You have to throw all this garbage and junk in the dumpster immediately!" "I know these items represent memories and value to you. Let's work together to create a safe path to the front door so paramedics can reach you if needed."
"How can anyone live like a pig in this disgusting mess?" "I can see how overwhelming things have become. You deserve to have a clean, peaceful place to sit and sleep comfortably. Can we tackle just this one chair today?"
"I'm coming over this weekend with a truck and throwing it all out whether you like it or not." "I won't touch or discard anything without your permission. You are in control of your belongings. My only goal is to help you stay safely in your home."
"Why do you keep 50 expired newspapers and broken appliances?" "I know you intended to repair these or find them a good home. Let's pick out the two most important ones to preserve, and look at donating or recycling the rest."
Operational Harm Reduction

The Harm Reduction Triage Hierarchy

When an individual cannot part with belongings, focus exclusively on life-safety criteria rather than aesthetic perfection.

PRIORITY 1

Clear 36" Emergency Egress

Ensure the front door, back door, and bedroom corridors have an unobstructed 36-inch clearance. Paramedics carrying a gurney require at least 32โ€“36 inches of flat floor space.

PRIORITY 2

3-Foot Combustible Buffer

Remove all newspapers, cardboard, and textiles within 36 inches of the stove, space heaters, baseboards, and electrical circuit breakers. Install interconnected smoke detectors.

PRIORITY 3

The "Sanctuary Room"

Dedicate one single room (usually the master bedroom) as a 100% clean zone. Ensure clean bedding, proper air filtration, and zero clutter overflow to preserve sleep hygiene.
